Applicable regulations

Italian legislation (Art. 122 of Legislative Decree 196/03, “Personal Data Protection Code”, hereinafter the “Code”) introduced into the Italian legal system a European Directive requiring website operators who use cookies or other tracking technologies to inform users about the types of cookies that may be used by the website.

The Decision of the Italian Data Protection Authority (Garante per la protezione dei dati personali) no. 229 of 8 May 2014, published in the Official Gazette no. 126 of 3 June 2014, classified cookies into two macro-categories: “technical” cookies and “profiling” cookies.

Technical cookies

Technical cookies are those used solely for the purpose of “carrying out the transmission of a communication over an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide that service” (see Art. 122, paragraph 1, of the Code).

They are not used for any additional purposes and are normally installed directly by the data controller or website operator. They may be divided into:

  • Navigation or session cookies, which ensure normal browsing and use of the website (allowing, for example, a purchase to be made or authentication to access restricted areas).

  • Analytics cookies, which may be treated as technical cookies when used directly by the website operator to collect information, in aggregated form, on the number of users and how they visit the website.

  • Functionality cookies, which allow the user to browse according to a set of selected criteria (for example, language or selected items) in order to improve the service provided.

For the installation of technical cookies, prior user consent is not required.

Profiling cookies

Profiling cookies are aimed at creating user profiles and are used to send advertising messages in line with the preferences expressed by the user while browsing the web.

Given the particularly invasive nature these devices may have within the user’s private sphere, European and Italian regulations provide that the user must be adequately informed about their use and must give valid consent.

Art. 122 of the Code provides that “the storage of information on the terminal equipment of a contracting party or user, or access to information already stored, is permitted only on condition that the contracting party or user has given their consent after being informed using the simplified procedures referred to in Article 13, paragraph 3” (Art. 122, paragraph 1, of the Code).

In the same Decision, the Data Protection Authority also classified cookies according to the party acting as data controller of the personal data collected by the cookie, distinguishing between first-party cookies and third-party cookies.

First-party cookies

These are cookies managed by the website owner. For these cookies, the obligation to provide the information notice lies with the website owner, who must also indicate how to block the cookies.

Third-party cookies

These are cookies managed by a third party other than the website owner. For these cookies, the obligation to provide the information notice and indicate how to block the cookies lies with the third party, while the website owner is required to include on the website a link to the third party’s website where such information is available.

In both cases (first-party or third-party cookies), the collection of consent—where required because the cookie is a profiling cookie—takes place through a specific banner on the website.
